The U.S. Environmental Protection Agency’s (EPA’s) mission to protect human health and the
environmentincludestheresponsibilitytoeffectivelymanage,withtheStates,thenation’shazardous
waste facilities regulated under the Resource Conservation and Recovery Act of 1976 (RCRA), as
amendedbytheHazardousandSolidWasteAmendmentsof1984(HSWA).

CONFIDENTIALBUSINESSINFORMATION(CBI)
Youmust report allinformationrequestedin theforms.Youmaynotwithholdinformation fromthe
Administrator ofthe EPA because you believe it is confidential .However, when the Administratoris
requested to consider inf ormation confidential, it must be treated according to the EPA regulations
containedin40CFRPart2,
SubpartB.Theseregulationsprovidethatabusinessmay,ifitdesires,assert
aclaimofbusinessconfidentiality coveringallorpartoftheinformationfurnishedtotheEPA.40CFR
2.203(b) explains how to assert a claim.The EPA will treat information covered by such a claim in

When you have filled out all the appropriate forms on your RCRA Subtitle C submission, number the
pages(eachpieceofpape risapage)consecutivelythroughoutyoursubmission.Donotnumbereach
setofformsseparately,butrathernumbereachpagesequentially.Theindividualpagenumberandthe
totalnumber
ofpagesinyoursubmissionshouldappearatthebottomofeachpage(e.g.,Page1of7,

AUTHORIZATION
Section3010 of SubtitleC of theResource Conservationand RecoveryAct(RCRA) requiresany person
who generates, transports , or recycles regulated wastes or who owns or operates a facility for the
treatment,storage,ordisposalofregulatedwastestonotifytheU.S.EnvironmentalProtectionAgency
(EPA)oftheiractivities,
includingthelocationandgeneraldescriptionoftheactivitiesandtheregulated
wastes handled. Respondents must submit the information required in the Notification of Subtitle C
Activities (870012). As required by statute, the EPA promulgated regulations to implement these
notificationrequirementsat40CFRParts260,261,262,263,264,
265,266,270,273,and279.TheEPA
needsthisinformationtodeterminetheuniverseofpersonswhogenerate,handle,andmanage these
regulated wastes; assign EPA Identification Numb ers; and ensure that these regulated wastes are
managed in a way that protects human health and the environment as required by
RCRA. This is
mandatoryreportingbytherespondents.
The EPA enters notification information submitted by respondents into RCRAInfo, the EPA nationa l
database,andassignsEPAIdentificationNumbers.TheEPAusesthisinformationtoidentifytheuniverse
ofregulated wastege nerators,handlers,andmanagersandtheirspecificregulatedwasteactivities.The
EPA
also uses the information for tracking and for a variety of enforcement and inspection purposes.
Finally,theEPAusesthisinformationtoensurethatregulatedwasteismanagedproperly,thatstatutory
provisionsareupheld,andthatregulationsareadheredtobyfacilityownersoroperators.
Section3007(b)ofRCRAand
40CFRPart2,SubpartB,whichdefinestheEPA’sgeneralpolicyonpublic
disclosure of information, both contain provisions for confidentiality. Howev er, the Agency does not
anticipatethatbusinesseswillassertaclaimofconfidentialitycoveringallorpartoftheNotificationof
SubtitleCActivity.Ifsuchaclaim
wereasserted,theEPAmustandwilltreattheinformationinaccordance
withtheregulationscitedabove.TheEPAalsowillassurethattheinformatio n collectioncomplieswith
thePrivacyActof1974andOfficeofManagementandBudget(OMB)Circular108.

INTRODUCTION
These instructionsare designed to help you determine if you are subject to requirements under the
ResourceConservationandRecoveryActof1976(RCRA),asamendedbytheHazardous andSolidWaste
Amendments of 1984 (HSWA) for notifying the U.S. Environmental Protection Agency (EPA) of your
regulated waste activities. Regulated
wastes are hazardous wastes as defined by 40 CFR Part 261,
universalwastes as definedby40 CFRPart273, andusedoilasdefinedby40 CFRPart 279.
Ifyouare
managinghazardoussecondarymaterialunder40CFR260.30,40CFR261.4(a)(23),(24),(25),or(27),
you
alsomustnotifyunder40CFR 260.42usingtheRCRA Subtitle CSite IdentificationFormand Addendums
tothe Site IdentificationForm. Inaddition,youmustnotifyif:
youare a facility that recycles hazardous wastewith aRCRA permit (i.e., stores the hazardous
wastepriortorecycling)(See
40CFR261.6(c));
youareafacilitythatrecycleshazardouswastewithoutaRCRApermit(i.e.,recycleswithoutfirst
storingthematerial)(See40CFR261.6(c)(2)(iv));
you are a very small quantity generator (VSQGs), previously called conditionally exempt small

DETERMININGIFYOUMUSTNOTIFY
HOWTODETERMINEIFYOU MUSTNOTIFYEPAOFYOURSUBTITLECACTIVITIES
Allpersonswhogenerate,transport,recycle,treat,store,ordisposeofhazardouswastearerequiredto
notify the EPA (or their State agency if the State is authorized to operate its own hazardous waste
program) of their hazardous waste activities. Furthermore, if you are managing hazardous secondary
materialunder40 CFR
260.30,40 CFR261.4(a)(23),(24),(25),or(27), you alsomust notify usingthe
RCRA SubtitleCSiteIdentificationFormandtheAddendumtotheSiteIdentificationForm:Notification
ofHazardousSecondaryMaterialActivity. Lastly,ifyouarearecognizedtraderarrangingforimportor

Thelistofgeneralexclusionscanbefoundin40CFR261.4.Ifthesolidwastethat

ISMY SOLID WASTE SPECIFICALLY LISTED AS A HAZARDOUSWASTE?
40 CFR 261.30 through 261.33 identify certain solid wastes that the EPA has specifically listed as
hazardous. PersonswhohandlelistedhazardouswastearesubjecttoregulationandmustnotifytheEPA
of their hazardous waste activities unless they are exempted as discussed below. Refer to these

DOES MY SOLID WASTE POSSESS AHAZARDOUS CHARACTERISTIC?
Evenifyoursolidwaste isnotspecificallylistedasahazardouswaste,itmaystillbehazardousbecauseit
exhibitscertainhazardouscharacteristics. Thesecharacteristicsare:
Ignitability;
Corrosivity;
Reactivity;and
Toxicity.

its own hazardous waste program) of their hazardous waste pharmaceutical activities.If a healthcare
facility does not already have an EPA identification number, it will receive one after notifying.If a
healthcarefacilityalreadyhasanEPA identificationnumber,itisstillrequiredtonotifythatitisoperating
undertheSubpartPregulations.HealthcarefacilitiesoperatingunderSubpartPthatgenerateaboveVSQG
amounts
of nonpharmaceutical hazardous waste must also comply with all of the 40 CFR Part 262

Usedoilthatistobeburnedforenergyrecoveryandthatmeetsthespecificationprovidedunder40CFR
279.11 is exempt from the regulations. However, the person who first claims that the used oil meets
the specification is subject to notification as a used oil fuel marketer and certain other requirements
(see40CFRPart279,SubpartH).Theburneroffuelthatmeetsthespecificationin40CFR279.11isnot
requiredtonotify.
